By creating an account or using biocartly, you agree to these terms. If you do not agree, do not use the platform.
2. The Service
biocartly provides software for South African sellers to create storefronts, manage products, accept payments, and process orders. Payments are processed by third-party providers such as Yoco and PayFast.
3. Account Responsibilities
- You must be at least 18 years old to create an account.
- You are responsible for accurate account, business, store, product, contact, pricing, and policy information.
- You are responsible for all activity under your account.
- You must protect your login credentials and payment provider keys.
- Store owners are responsible for staff access, staff permissions, and removing access when staff no longer need it.
4. Store Content and Policies
Sellers should provide public-facing contact information and clear delivery, fulfilment, refund, return, exchange, cancellation, and support policies where relevant. Sellers are responsible for making sure store content, product images, product descriptions, prices, stock information, and social links are accurate and do not mislead customers.
5. Acceptable Use
- You may not use biocartly to sell illegal, stolen, counterfeit, misleading, unsafe, or prohibited goods or services.
- You may not use biocartly for fraud, phishing, impersonation, spam, scams, or malicious activity.
- You may not upload content or sell products that infringe another person's intellectual property or legal rights.
- You may not bypass platform limits, payment checks, security controls, or technical restrictions.
- You must follow South African law, customer protection rules, tax obligations, payment provider rules, and any other rules that apply to your business.
6. Payments and Subscriptions
Paid plans are billed through PayFast. Customer checkout payments are processed by connected payment providers such as Yoco. You are responsible for following the terms, verification requirements, settlement rules, chargeback rules, and prohibited business rules of any payment provider you connect. You may cancel a biocartly subscription from billing settings, subject to the plan and billing cycle active on your account.
7. Customer Transactions
Sellers are responsible for fulfilling orders, handling customer support, managing refunds where required, and complying with consumer protection, tax, delivery, product safety, advertising, and other applicable laws. biocartly provides commerce software and is not the seller of record for the seller's products.
8. Intellectual Property
You retain ownership of your store content and grant biocartly a limited licence to host and display that content so we can operate the service.
9. Platform Enforcement
We may remove content, restrict a store, suspend an account, request verification, or refuse service where we reasonably believe there is legal risk, fraud risk, payment provider risk, customer safety risk, intellectual property risk, or a breach of these terms.
10. Third-Party Services
biocartly relies on third-party services for hosting, authentication, payments, email, storage, monitoring, and other platform functions. Those services may have their own terms and availability. We are not responsible for third-party service interruptions outside our reasonable control.
11. Limitation of Liability
biocartly is provided as is. To the fullest extent allowed by law, we are not liable for indirect losses, lost revenue, or service interruptions.
12. Governing Law
These terms are governed by the laws of the Republic of South Africa.
